DOC Sends Out Notice to Operators to Address Mandates of Senate Bill 4

With the passage of Senate Bill 4 (SB 4), the Public Resources Code (PRC) will be amended as of January 1, 2014. One new PRC section, 3161, requires operators to provide the written notice certifying compliance with core SB 4 mandates before conducting well stimulation treatments, such as hydraulic fracture stimulation. On January 1, 2014, the Division of Oil, Gas, and Geothennal Resources (Division) will have emergency regulations in place that will detail the procedures for compliance with PRC section 3161. However, the SB 4 mandates will impact operators before January 1, 2014 because steps must be taken before that date if an operator wishes to conduct well stimulation treatments in the month of January.

SB 4 requires operators to contract with an independent entity to provide notification to neighboring property owners and tenants at least 30 days in advance of a well stimulation treatment. Therefore, for an operator to be able to perform a well stimulation treatment on January 1, 2014, neighbor notification regarding the well stimulation treatment must be completed by December 2, 2013.
